Non-Fault Claim

If you have been involved in a road traffic accident where someone else is to blame and you have their details. We understand that this can be a stressful time so below is some advice to help you, answer your questions and ease any worries. View more frequently asked questions.

Can I still claim if an uninsured driver hit me?

If you are comprehensively insured you will be able to claim for your damage from your own Insurance which will unfortunately mean that your excess applies and the claim may affect your no claims bonus and premiums. If you are covered third party, fire and theft you will not be able to claim for your damages from your policy.

Do I have Legal Expense Insurance?

We provide all of our policy holders with legal expense cover with Angel Assistance who can assist with claiming back any uninsured losses as the result of a non-fault road traffic accident and may be able to provide a hire vehicle. Please contact our claims department with the details of the third party involved and they can instruct the legal cover for you from up to 90 days of the accident date.

Will I be provided with a courtesy vehicle?

If you are comprehensively insured you may be entitled to a courtesy car for the duration of repairs whilst using one of your Insurance Company's approved repairers. The service is subject to availability and for the duration of repairs only. You will not be entitled to a courtesy car if your vehicle is not repairable or uneconomical to repair likewise if your vehicle has been stolen. The full terms of this service will be outlined in your policy booklet.

Alternatively, Angel Assistance may be able to arrange a like for like hire vehicle whilst your vehicle is being repaired or until you receive a settlement offer from your Insurers if your vehicle is written off. The service is provided by Helphire, a sister company to Angel Assistance. You can call Helphire on 0500 22 44 55.

Do I have to pay my policy excess?

If you are comprehensively insured there are two available options when another driver has hit you. The first option is that your legal cover with Angel Assistance may be able to deal with the claim in full for you, which means you will not have to pay your policy excess. You would be required to use one of their approved garages and also have a hire vehicle from them. If you do not require a hire vehicle or you wish to use your own choice of garage or if your vehicle is a total loss then you would have to claim from your own Insurance policy. This means that the policy excess is payable but your legal cover will assist you with reclaiming this back from the Third Party Insurers once you provide them with the proof of payment.

How long does it take to reclaim back my excess?

Every claim is different so there is no set timescale here. Angel Assistance will continue to chase the Third Party Insurers and where necessary they will pass the file to Temple Street Solicitors to represent you in negotiating a settlement.

My policy cover is third party, fire and theft, am I still able to claim?

Although you are unable to claim through your own Insurance, because the accident was not your fault we can instruct your legal cover, Angel Assistance to handle the claim in full for you. They will be able to assist you with claiming for your damages from the Third Party Insurers.

Can I claim for injuries?

Your legal cover, Angel Assistance can help you and any passengers claim compensation for injury. A firm of solicitors are usually appointed for these cases, should you require further information about the solicitors please contact our claims team.

Why are there so many different companies involved?

It is beneficial to have different companies involved during the process of a non-fault claim as each company is a specialist in their own field.

Am I able to use my own choice of solicitors?

You are more than welcome to use companies other than Angel Assistance if you feel that they can provide a better service, however you should be aware that Angel Assistance would not be able to provide any service for you.

Does a non-fault accident affect my premium?

All pending claims are classed as fault therefore if the claim is still pending when your renewal is due then the rate may be affected until such a time that the claim is settled 100% in your favour. If you cancel your Insurance you will not be allowed any refund that may be due until the claim has been settled completely non-fault.

I am not happy with the repairs to my vehicle, how can they be rectified?

If you have used an approved repairer you will firstly need to go back to the garage and give them a chance to rectify the work. Should you still encounter problems please contact our claims team who will refer back to your Insurance Company. Unfortunately we cannot assist if you have used your own choice of garage.

My vehicle is a total loss, what should I do next?

Your Insurers will contact you and ask you to send in your vehicle documents which we recommend you send via recorded delivery post, our claims department will be able to check with your Insurers which documents will be needed.

How long will it be before I receive a payment from my Insurance Company?

Each claim is different so there is no fixed answer to this question. Our claims team will liaise with your Insurers to obtain a payout for you as soon as possible.

What do I do if I don't agree with the amount the Insurers have offered me?

If you don't agree with the offer you can provide evidence to support the value that you feel the vehicle is worth. Examples of such evidence are clippings from magazines or newspapers with a car of the same specification, or links to websites showing cars of the same specification. Remember that your Insurers will look at the condition of the car, the mileage, the model, the year of make, and many other factors. It is important that you provide as much evidence as you can but do ensure that the vehicle can be directly compared to your own.

My vehicle has been written off, am I able to retain the salvage?

Every Insurer has different terms and conditions in regards to this so there is no fixed answer to this question. Our claims team will be able to liaise with your Insurers for you and find out if this would be possible.
